Violations of Court Orders

Jul 15, 2024

When the other side violates an order, and you are out of money from the attorney fees from the initial court proceedings, the frustration can mount over what to do.

What you need to realize is that you cannot withhold visitation but you can take the other side back to court on a contempt motion and ask for your attorney fees to be paid by the other side. Contempt is the typical remedy for failure to pay child support. If the court finds a party in contempt for failure to pay court-ordered child support, the penalties can include jail time, fines, and an order to pay the attorney’s fees incurred in the contempt proceeding. Frequently, once the other side receives your contempt papers he or she will come up with a settlement offer and find a way to pay the child support that is owed. Sometimes this is the only way a person takes seriously what he or she is required to do. – Kevin J. Waite, P.C.
